In day to day life, the terms 'lawyer' and 'advocate' are commonly used as synonyms. However, in legal terms their meanings are quite different. In the following article, the difference as well as meaning would be discussed-
Who is A Lawyer- A person who has completed his law degree or is pursuing one, or has a law degree, is a lawyer. Thus, anyone who has a degree of law, i.e LL.B. or five year integrated course, is a lawyer. Such a person can give legal advice, but cannot represent his client in the Court of Law.
Who is an Advocate- A Lawyer when enrolls himself in the Bar Council, he is known as an Advocate. Thus, only after enrolling himself in the Bar Council can a person represent his client in the Court of Law. This is the main difference between an Advocate and a Lawyer.
Another commonly used term is 'Barrister'. The word 'Barrister' is similar to 'Lawyer', if a person has completed his degree of law from India, he is known as a lawyer, but if the degree is completed from England he will be called Barrister.
Difference Between Lawyer and Barrister-
· A person pursuing or completing a law degree is called a lawyer, while a lawyer who has enrolled with the Bar Council is an advocate in delhi.
· If he has to represent his client in the Court of Law, a lawyer has to enroll his name in the Bar Council, while an Advocate has already enrolled with the Bar Council and can represent his client in the Court of Law.
· While talking about experience, say for example, a lawyer would be less experienced in the field, for the simple reason that he is a fresher, while an advocate can be said to be more experienced.
· A lawyer can provide legal advice to his client, but cannot represent him in the court of law, while an advocate is more experienced in the field of law, and can provide more guidance regarding the procedures of the court.
· For providing advice, say for example, even the best lawyer in Delhi will charge less fee as they can only provide legal advice or guidance, however an advocate in Delhi will charge more fees for the same advice or guidance, as he can represent the client in the court of law and because he has more knowledge as well experience in the field.
· A Lawyer can't be called an Advocate, but an Advocate can also be called a Lawyer.
How Can a Lawyer Become an Advocate-
Even the best advocate in Delhi starts with being a lawyer, only after completing the procedure as decided by the law, can he become an advocate. A lawyer is a person who has a degree in law, after completing his degree, he can give legal advice, but can't represent in the court of law, to do so he has to get himself enrolled in the Bar Council. In India, a lawyer has to clear the exam of the Bar Council of India, after which the Bar would provide him the license to practice, thus making him an advocate.
