What Documents Required For Court Marriage in India for Nris

When the bride and groom are adherents of Hinduism, Buddhism, Jainism, or Sikhism, or have converted to one of these faiths, the Hindu Marriage Act applies. The Hindu Marriage Act specifies the requirements for a marriage, including the age requirements for the bride and groom, who must both be at least 18 years old and not be involved in any banned relationships.


The Hindu Marriage Act of 1955 mentions Buddhists, Sikhs, Jains, and Hindus. The Hindu Marriage Act of 1955 allows for the registration of recently solemnized stringent marriages. When both members of a couple are Hindus, Buddhists, Jains, or Sikhs, or have converted to any of these religions, the Hindu Marriage Act applies.


The Hindu Marriage Act recognises the requirement that the bride be 18 years old and the groom be at least 21 years old. There shouldn't be any indication of a forbidden relationship between the two.


Assume that one of the parties is a citizen of a different country, such as the USA, the UK, or another. In that situation, the registrar may ask the country's embassy or consulate for a "no objection letter." Before issuing a marriage certificate, it may ask for evidence that all prior marriages have been legally dissolved.

If one of the parties happens to be a resident of the United States, the registrar may request a "no objection letter" from the American Consulate or Embassy. Before the couples are given a marriage certificate, it can also demand proof of a future divorce.


Documents required under Hindu Marriage Act:

  • Application form duly completed by the couple

  • Documentation proving the birthdates of the husband and wife (passport, matriculation certificate, and birth certificate).

  • According to the Special Marriage Act Ration card of the spouse or wife whose area SDM has been approached for the Certificate, the minimum age of the husband and wife is 21 years old at the time of enrollment.

  • A declaration signed by the bride's and the groom's parties specifying the wedding's location and date, the couple's birthdates, and their marital status at the time of the union.

  • Two passport-sized photos, as well as one shot of the couple taken at their wedding.

  • Wedding card, if one is available.

  • If the marriage was performed in a religious setting, a priest's witness certificate is necessary.

  • An affirmation that both parties are not related to each other and are not within the forbidden degree of relationship as per the Hindu Marriage Act or Special Marriage Act.

  • Copy of the divorce decree or separation decree, if applicable, and the death certificate of the life partner, if applicable, for widows and widowers.

  • A priest performing the marriage said that one of the parties had converted to a faith other than Hindu, Jain, Buddhist, or Sikh.

  • Just the receipt must have an attestation from a Gazetted Officer.

Documents required under Special Marriage Act:

  • a current passport

  • original birth certificate with the names of the guardians

  • The original death certificate of the person's deceased spouse, if they were widowed.

  • If the parties are divided, a copy of the final decree or document proving their extended stay in India (ration card or report from the concerned SHO)

A "no objection letter" from the U.S. Consulate or Embassy, together with documentation of the dissolution of any prior marriages, may be required of the American resident who desires to participate in a civil marriage ceremony to be presented to the marriage official.

A resident of another country may also be required to provide the registrar with a "no objection letter" from the consulate or embassy of that country as well as documentation of the dissolution of any prior marriages.
