Special Marriage Act, 1954 provides for the provision of court marriages in India. The Act provides validity of the marriages between persons belonging to different castes, religion, place of birth, race, etc without any discrimination. A court marriage could be understood as a marriage solemnised according to the procedure provided by the law. The parties interested to marry through court can apply for the same to the marriage registrar of their area so as to obtain a marriage certificate. Eligibility for the court marriage-

  • The bride is required to be at least 18 years old at the minimum, while the groom must be 21 years old or more.

  • The parties shall be of sound mind.

  • The parties should not fall within the degrees of prohibited relationship.

Process of Court Marriage

  1. Notice of marriage- the parties will have to give a notice to the marriage officer, as per the provisions of the Act, under whose jurisdiction either of the parties have been living for a period not less than 30 days. The parties are required to provide the notice of the intended marriage in writing and in the form as prescribed under the Second Schedule of the Act.

  2. Publish the notice- the marriage officer will then publish the notice for marriage by affixing it in some inconspicuous part of his office so as it is visible to the general public. The notice is required to be published for a period of 30 days from the day such notice was submitted, so that an objection against such a court marriage application could be raised within this period.

  3. Objection- as has been mentioned under Section 7 of the Act, an objection to a court marriage application could be raised on the basis of the grounds provided under Section 4 of the Act and not on a personal basis but on the legal grounds. The marriage officer, as provided under Section 8 of the Act, must enquire about the validity of such objection raised within a period of 30 days from the day the objection was filed. If the objection so raised is found to be invalid, the marriage officer would then solemnise the marriage.

  4. Parties and the witnesses are to be present on the date of marriage- three witnesses as required shall be present in the court marriage. Signature and declaration provided under Third Schedule of the Act, the parties and the witnesses would then sign the documents in the presence of the Marriage officer.

  5. Certificate of Marriage- after the above mentioned steps have been completed, the parties will be issued the marriage certificate. The certificate is required to be signed by the parties and the witnesses. The certificate so issued is conclusive evidence of the court marriage.
