HOW MUCH DO HIGH COURT LAWYERS CHARGE IN INDIA?

An advocate plays a critical role in the administration of justice. Advocates assist people in resolving their problems and ensuring their rights. The Preamble of the Constitution of India guarantees all the citizens of the country socio-economic and political fairness. Articles 14 and 16 of the Indian Constitution provide an implied responsibility to the State to ensure that no one is denied legal help due to economic reasons or any other reason.


Article 39-A of the Constitution provides that the State shall offer free legal aid through appropriate legislation, so as to ensure that no citizen’s right to justice is denied due to any economic or any other reason.

  • The charge for the legal fees vary from client to client as the lawyer could be charged according to the paying capacity of the client. It has been observed that the lawyers could charge from Rs 3 to 6 lakhs per hearing for the cases in the High Court or if the lawyer has to travel to another High Court, then in such a situation, the fees could be as high as Rs 25 lakhs.

  • Also, there have been instances where it is seen that the lawyers demand a considerable percentage of the amount received by the clients in the accident claims for their fees.

  • In the case of Sunitha v State of Telangana, the Supreme Court accepted the issue of hefty fees which are being charged by the legal professionals. It was decided by the Apex court that the fees of the advocates which is based on the percentage of the amount to be provided in the judgement is illegal and shall not be entertained.

Conclusion

The legal profession is a well-respected and an honoured job in the country. The job of a lawyer is not only to represent his client, but also to ensure that justice is served and no one is denied his/ her rights.
