Section 5 states: The couples desire to do Court marriage in India at any place\city other than their residential place they can, by fulfilling one condition i.e. The notice given to the marriage officer of the district where at least one of the party, let’s say groom, must have stayed for 30 days, after sending the intended notice to the marriage court in written form.

The mandatory period of 30 days stay is only applicable if the couples are looking to court marriage in some other city than their resident city, under schedule 2 of the act.
Procedure for the Court Marriages-

Step 6: Marriage is solemnized in accordance with the rules and regulations of the law (SMA 1954) the marriage registrar will input the details of the parties and witnesses issued the marriage certificate to the couple where the Court marriage is valid under the special marriage act of 1954.
What is the prerequisite for the court marriage in India under the act (SMA 1954)

The parties shall have a valid consent from each other to get married.
The girl and boy should be available to match their legal age for marriage (I.e. girl- 18 & boy- 21)
